Principles of processing personal data

1. PRELIMINARY PROVISIONS

PHOTOMATE s.r.o., Company ID No. 260 80 249 , with registered office at Prokišova 356/7, 37001 České Budějovice, entered in the Commercial Register under file number C 12740 kept at the Regional Court in České Budějovice (hereinafter referred to as the "Company"), hereby informs you in accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter also referred to as "GDPR Regulation") together with Act No. 110/2019 Coll, on the processing of personal data, as amended, has adopted this personal data processing policy (hereinafter referred to as the "Policy"), which explains how we collect and handle personal data in the course of our activities.

This Policy also binds other members of the PHOTOMATE Group, wherever they act as controllers or processors of personal data. Members of the PHOTOMATE Group are:

(hereinafter the "PHOTOMATE Group").

2. DATA CONTROLLER

The Controllers of personal data are the Company and the member of the PHOTOMATE Group who collected the personal data (hereinafter referred to as the "Controller"). The contact person of the Controller in matters of personal data protection is MVDr. Jozef Cehlár, tel.: 724 329 556, email: jozef.cehlar@photomate.eu. No data protection officer is appointed.

3. PROCESSED PERSONAL DATA

For the above purposes, the following personal data are processed by the Controller:

  • identification data - name, surname and affiliated company
  • contact details - email
  • photographs and video recordings from the organised training course, in which your image may be recognisable
  • other data provided to us for the purposes set out above

4. THE PURPOSES OF THE PROCESSING OF PERSONAL DATA AND THE LEGAL BASIS FOR THE PROCESSING

The legal basis for the processing of personal data in the scope of name, surname, affiliated company and email address is our legitimate interest in improving the quality of organised professional training and improving the qualifications of employees within the distribution network, where this legitimate interest is also the purpose of the processing of personal data. The legal basis for the processing of personal data in the scope of name, surname and email address is also consent, for the purpose of direct marketing of relevant training courses and products of the PHOTOMATE Group via email.

The legal basis for the processing of photographs and video recordings of the training course, in which your image may be recognisable, is your consent, where the purpose of processing this personal data is the marketing promotion of the PHOTOMATE Group.

The legal basis for the processing of personal data is also the fulfilment of the contract, the fulfilment of the requirements of the law and the protection of the vital interests of the interested parties, if the necessity of such processing results from the concluded contract, legal regulation or the presence of the vital interest of the interested parties.

5. PERSONAL DATA SECURITY

As part of the processing of personal data, technical and organisational measures have been taken to ensure the protection of personal data, in particular to prevent unauthorized or accidental access to personal data, their alteration, destruction or loss, unauthorised transfers, their other unauthorised processing, as well as other misuse of personal data data, even after the termination of personal data processing. This is in particular the restriction of physical access to premises used for business, the determination of only a limited number of specific persons who have access to the data and who have an obligation of confidentiality in relation to this data or the use of professional security programs.

6. PERSONAL DATA RECIPIENTS

The personal data provided will be processed mainly by the Controller. Your personal data may also be provided or made available to other third parties under certain conditions set by law, if necessary. All recipients of personal data provide sufficient guarantees regarding the organisational and technical security of personal data.

7. TRANSFER OF PERSONAL DATA

The Controller transfers personal data within the PHOTOMATE Group if this is necessary for the fulfilment of any of the purposes pursuant to Art.

The Controller does not transfer and does not intend to transfer your personal data to a third country, i.e. to a country outside the European Union or to an international organisation.

8. PERIOD OF PERSONAL DATA PROCESSING

Personal data will only be processed by the Controller for the time necessary for the purpose of their processing, as follows:

  • processing on the basis of consent, for a period of seven years or until the consent is withdrawn;
  • processing on the basis of our legitimate interests for a period of seven years,
  • processing as a result of statutory provisions, for as long as the law requires.
  • processing as a result of the conclusion of a contract or the provision of a service, for the duration of the performance of that contract or the provision of the service and, where applicable, thereafter if the law allows, in particular for the purpose of defending any legal claims or legal proceedings.

9. RIGHTS OF PERSONAL DATA SUBJECTS

The personal data subject has the right to access all his/her personal data processed by the Controller, the right to request rectification, erasure or restriction of the processing of personal data and the right to raise an objection with the Controller regarding the processing of personal data. All these rights can be exercised by the subject with the Controller by email sent to the email address of the Company's contact person in matters of personal data protection under point 1 above or contact email see point 10. Furthermore, the data subject has the right to lodge a complaint with the locally competent authorities or data protection authority (see: https://www.edpb.europa.eu/about-edpb/about-edpb/members_en).

11. EFFECT

This Policy comes into effect on 01/06/2024. The Data Controller reserves the right to amend this Policy from time to time without prior notice, in particular to ensure an adequate level of protection of personal data, to take into account the development of legal regulations or generally accepted practices. We will inform you of any changes to this Policy.
