V souladu se zákonem č. 171/2023 Sb., o ochraně oznamovatelů (ZOO), zavádí společnost PHOTOMATE s.r.o. se sídlem Prokišova 356/7, České Budějovice 6, 370 01 České Budějovice, IČ: 26080249 (dále jenom Společnost) vnitřní oznamovací systém a poskytuje ochranu osobám upozorňujícím na možné protiprávní jednání.

Jaká jednání lze oznamovat?

Oznamovatel tzn. osoba, která se o možném protiprávním jednání, k němuž došlo nebo má dojít u Společnosti, dozvěděla v souvislosti s výkonem práce nebo jiné obdobné činnosti pro Společnost může poskytovat informace o tomto jednání pokud:

má znaky trestného činu, nebo
má znaky přestupku, za který zákon stanoví sazbu pokuty, jejíž horní hranice je alespoň 100 000 Kč,
porušuje zákon o ochraně oznamovatelů nebo
finančních služeb, povinného auditu a jiných ověřovacích služeb, finančních produktů a finančních trhů nebo
porušuje jiný právní předpis nebo předpis Evropské unie

Přijímání oznamování od osob, které pro Společnosti nevykonávají práci nebo jinou obdobnou činnost, prostřednictvím vnitřního oznamovacího systému Společností, se vylučuje. Tyto osoby mohou podávat oznámení prostřednictvím externího oznamovacího systému Ministerstva spravedlnosti.

Jaké oznámení je vyloučeno?

Z ochrany jsou vyloučena především vědomě nepravdivá oznámení, tedy oznámení informací, o nichž neměl oznamovatel oprávněné důvody se domnívat, že jsou pravdivé.

Z ochrany jsou dále vyloučena oznámení obsahující utajované informace nebo informace, jejichž oznámení by mohlo bezprostředně ohrozit podstatný bezpečnostní zájem České republiky.

Jakým způsobem lze oznámení podat?

A. Prostřednictvím vnitřního oznamovacího systému Společnosti

Písemně, telefonicky nebo osobně v místě sídla Společnosti po předchozí domluvě s příslušnou osobou.

Oznámení musí obsahovat údaje o jménu, příjmení a datu narození, nebo jiné údaje, z nichž je možné dovodit totožnost oznamovatele, není-li pověřené osobě totožnost oznamovatele prokazatelně známa. Oznámení musí dále obsahovat pravdivý popis skutečností, které nasvědčují protiprávnímu jednání u Společností.

B. Prostřednictvím Ministerstva spravedlnosti České republiky

Jaká je lhůta pro vyřízení oznámení?

Oznamovatel, který podal oznámení prostřednictvím vnitřního oznamovacího systému obdrží:

do 7 kalendářních dnů potvrzení o tom, že oznámení bylo přijato
nejpozději do 30 dnů od přijetí oznámení vyrozumění o tom, jakým způsobem bylo oznámení posouzeno. Lhůta na prošetření může být ve složitých případech dvakrát prodloužena o 30 dnů (celkem tedy na 90 dnů).

Jak je chráněna osoba oznamovatele?

Přijímání a vyřizování podnětů v rámci tohoto systému je technicky i organizačně nastaveno takovým způsobem, aby nemohlo dojít k odhalení identity oznamovatele Přístup k oznámení má pouze příslušná osoba, informace o totožnosti oznamovatele je možné poskytnout jen s jeho písemným souhlasem nebo stanoví-li tak jiný právní předpis.

Oznamovatel nebo jiná chráněná osoba:

má nárok na ochranu podle Směrnice Evropského parlamentu a Rady (EU) 2019/1937 ze dne 23. října 2019, o ochraně osob, které oznamují porušení práva Unie v platném znění
nebude v souvislosti s důvodně podaným oznámením (jak prostřednictvím vnitřního oznamovacího systému, tak i prostřednictvím ministerstva) vystavena odvetnému opatření, tj. takovému jednání ve vztahu k práci nebo jiné obdobné činnosti oznamovatele, které oznamovateli nebo jiné chráněné osobě může způsobit újmu.
